Terms & Conditions
Effective Date: September 16, 2026
These Terms & Conditions ("Terms") govern your use of the Curbmate Trash Services website and any services provided by Curbmate Trash Services ("Curbmate," "we," "us," or "our"). By using our website, submitting a form, requesting service, purchasing a service, or otherwise engaging Curbmate, you agree to these Terms. If you do not agree to these Terms, please do not use our website or services.
1. Our Services
Curbmate Trash Services provides residential trash-related services, which may include trash bag pickup, curbside assistance, trash and recycling cart services, recurring scheduled services, one-time services, and other related services offered by Curbmate from time to time.
Specific services, pricing, schedules, service areas, and service requirements may vary. Submitting a website form or requesting information does not guarantee that Curbmate will accept or perform a requested service.
2. Service Area and Availability
Services are available only within areas currently serviced by Curbmate. We reserve the right to establish, modify, expand, restrict, or discontinue service areas at any time.
Service availability may also depend on scheduling, staffing, property accessibility, weather, road conditions, safety considerations, and other operational factors.
3. Customer Responsibilities
Customers are responsible for providing accurate information regarding their property, service needs, contact information, trash or recycling containers, and any other information reasonably necessary for Curbmate to perform the requested service.
Depending on the service purchased, customers may be responsible for ensuring that:
- Trash, recycling, bags, or containers are accessible at the required time.
- Gates, driveways, walkways, and access points are reasonably accessible and safe.
- Pets are secured when necessary for our team to safely access the property.
- Bags and containers do not contain prohibited or hazardous materials.
- Containers are not overloaded or otherwise unsafe to move.
- Curbmate has any necessary instructions regarding gates, container locations, or other access requirements.
- Any required permission to access the property has been obtained.
Curbmate is not responsible for a missed or incomplete service resulting from inaccessible containers, locked gates, unsafe conditions, incorrect information, obstructed access, unsecured animals, or other circumstances within the customer's control.
4. Acceptable Waste and Prohibited Materials
Curbmate's standard services are intended for ordinary residential household trash and other materials specifically accepted as part of the service purchased.
Unless expressly agreed to in advance, customers may not place hazardous, dangerous, illegal, or otherwise inappropriate materials for Curbmate to handle.
Prohibited materials may include, but are not limited to:
- Hazardous chemicals
- Flammable or explosive materials
- Gasoline, fuel, or other combustible liquids
- Propane tanks
- Medical or biohazardous waste
- Needles or exposed sharps
- Human or animal waste that is not properly contained
- Paint, solvents, pesticides, or similar chemicals
- Batteries requiring special disposal
- Hot ashes or burning materials
- Construction or demolition debris
- Extremely heavy items
- Appliances, furniture, or bulk items unless specifically approved
- Any material prohibited by applicable law or by the applicable waste collection or disposal provider
Customers are responsible for the contents of all bags, containers, and materials presented for service.
Curbmate may refuse to handle any material that our team reasonably believes is unsafe, prohibited, excessively heavy, improperly contained, or outside the scope of the purchased service.
5. Bag, Container, and Weight Requirements
Trash bags and containers must be reasonably safe for our team to handle. Bags must be securely closed and should not be overloaded, leaking, torn, or contain exposed sharp objects.
Containers must be maintained in a condition that allows them to be safely moved. Curbmate may refuse service for any bag or container that is excessively heavy or presents a reasonable risk of injury, spilling, property damage, or equipment damage.
Additional charges may apply when the amount of waste or work required materially exceeds the service purchased.
6. Recurring Services
Certain Curbmate services may be offered on a recurring weekly, monthly, or other scheduled basis.
By enrolling in a recurring service, you authorize Curbmate to continue providing and billing for that service according to the selected plan until the service is canceled in accordance with the applicable cancellation terms.
Service schedules may occasionally change because of holidays, weather, staffing, municipal collection schedules, operational needs, or circumstances outside Curbmate's reasonable control.
We may communicate schedule changes by email, text message, phone, website notice, or another reasonable method.
7. Pricing and Payment
Pricing is based on the service selected and any applicable service details disclosed at the time of purchase or enrollment. Customers agree to pay all charges associated with services they authorize.
Curbmate may modify pricing for future services or billing periods. When reasonably required, customers enrolled in recurring services will be notified of material pricing changes before the new pricing takes effect.
Applicable taxes, fees, surcharges, or additional service charges may be added when appropriate.
8. Recurring Payment Authorization
If you provide a payment method for recurring service, you authorize Curbmate and its payment processor to charge that payment method for recurring fees and other authorized charges associated with your service.
This authorization remains in effect until your recurring service is canceled or the authorization otherwise ends. You are responsible for maintaining accurate and current billing information.
If a payment is declined or cannot be processed, Curbmate may suspend or discontinue service until the outstanding balance is resolved.
9. Cancellations and Changes
Customers may request cancellation or modification of recurring services by contacting Curbmate using the contact information provided below.
Cancellation stops future service and billing in accordance with any cancellation deadline or billing period disclosed when the service was purchased.
Amounts already charged for services performed or service periods already begun may be non-refundable except where otherwise required by law or expressly agreed to by Curbmate.
One-time services may be subject to separate cancellation or rescheduling requirements disclosed at booking.
10. Missed Services
If Curbmate is unable to complete a scheduled service because of circumstances within our control, we may, depending on the circumstances, return to complete the service, provide a credit, reschedule the service, or provide another reasonable remedy.
A service will generally not be considered missed by Curbmate when service could not be completed because:
- Trash or containers were not accessible.
- Trash was not ready within the required service window.
- A gate or access point was locked.
- An animal prevented safe access.
- The property or access route was unsafe.
- The materials presented were prohibited or unsafe.
- The amount of trash exceeded the purchased service.
- Information supplied by the customer was incorrect or incomplete.
- Circumstances outside Curbmate's reasonable control prevented service.
Customers should contact Curbmate promptly if they believe a scheduled service was missed.
11. Weather, Emergencies, and Unsafe Conditions
Curbmate may delay, reschedule, modify, or cancel service when conditions make service unsafe or impractical.
These conditions may include severe weather, snow or ice, flooding, extreme temperatures, road closures, emergencies, equipment failures, governmental actions, utility issues, or other circumstances outside our reasonable control.
The safety of our employees, customers, and the public takes priority over maintaining a scheduled service time.
12. Property Access
When a service requires Curbmate personnel to enter a driveway, walkway, yard, enclosure, garage area, or other portion of private property, the customer authorizes Curbmate to access the areas reasonably necessary to perform the purchased service.
Customers are responsible for identifying unusual hazards, fragile property, defective gates, damaged pavement, hidden obstacles, or other conditions that could reasonably affect safe service.
13. Property Damage
Curbmate will use reasonable care while performing services. Customers should notify Curbmate promptly if they believe Curbmate caused property damage.
Curbmate is not responsible for ordinary wear and tear, pre-existing damage, deterioration, defective property, damage caused by overloaded or defective containers, hidden conditions, or damage that occurs despite the exercise of reasonable care.
Nothing in these Terms is intended to waive rights or responsibilities that cannot legally be waived under applicable law.
14. Third-Party Waste Collection
Certain Curbmate services may involve moving a customer's trash or recycling container to or from a location where it is serviced by a municipality, waste hauler, property manager, or other third party.
Unless expressly stated otherwise, Curbmate is not the customer's municipal or private waste disposal provider.
We do not control and are not responsible for a third party's collection schedule, missed pickup, disposal policies, container requirements, delays, refusal to collect materials, or changes to its services.
Customers remain responsible for complying with the requirements of their applicable waste collection provider.
15. Communications and SMS
By providing your phone number, you consent to receive communications from Curbmate relating to inquiries, quotes, scheduling, service updates, account information, billing, customer support, and other communications related to your relationship with Curbmate.
If you separately consent to receive marketing text messages, you may receive promotional messages from Curbmate. Consent to receive marketing text messages is not a condition of purchasing services.
Message frequency may vary. Message and data rates may apply. You may opt out of marketing text messages by replying STOP. You may reply HELP for assistance.
Transactional or service-related communications may still be sent when reasonably necessary to administer services you have requested, subject to applicable law.
We do not sell or share SMS opt-in consent or phone numbers with third parties for their independent marketing purposes.

17. Intellectual Property
Unless otherwise stated, the Curbmate name, branding, website design, written content, graphics, photographs, logos, service descriptions, and other original website materials are owned by or licensed to Curbmate Trash Services.
You may use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify, publish, sell, or commercially exploit our protected content without prior written permission.
18. Third-Party Services and Links
Our website may contain links to or integrations with third-party websites and services, including payment processors, scheduling tools, mapping services, analytics providers, social media platforms, or other service providers.
Curbmate does not control these third parties and is not responsible for their independent practices, content, availability, security, or privacy policies. Your use of third-party services may be subject to separate terms and policies.
19. Disclaimer of Warranties
To the fullest extent permitted by law, our website and services are provided on an "as available" basis.
We do not guarantee that our website will always be uninterrupted, error-free, or free from harmful components. We also do not guarantee the availability of any particular service, service date, route, schedule, or service area unless specifically confirmed by Curbmate.
Nothing in this section limits any warranty or consumer right that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Curbmate will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website or services.
Curbmate is not responsible for losses caused by events outside our reasonable control, actions of third-party waste collection providers, inaccurate information supplied by customers, inaccessible property, prohibited materials, or violations of these Terms by a customer.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Curbmate Trash Services and its owners, employees, contractors, representatives, and agents from claims, damages, losses, liabilities, and reasonable expenses arising from your violation of these Terms, unlawful conduct, misrepresentation, or placement of prohibited or dangerous materials for Curbmate to handle.
22. Suspension or Termination of Service
Curbmate may refuse, suspend, or terminate service when reasonably necessary, including for:
- Nonpayment.
- Repeated inaccessible or unsafe service conditions.
- Abuse, threats, harassment, or dangerous conduct toward our employees or contractors.
- Repeated presentation of prohibited materials.
- Fraud or misrepresentation.
- Misuse of services.
- Circumstances that make continued service unsafe or impractical.
Customers remain responsible for charges properly incurred before termination.
23. Changes to These Terms
We may update these Terms periodically to reflect changes to our services, business practices, technology, or legal requirements.
Updated Terms will be posted on our website with a revised effective date. Your continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
24. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute arising from these Terms or Curbmate's services will be subject to the courts having jurisdiction under applicable law, unless the parties agree to another lawful dispute-resolution process.
25. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
26. Entire Agreement
These Terms, together with our Privacy Policy and any applicable service-specific agreement, order, subscription, or authorization, constitute the applicable agreement between you and Curbmate regarding the matters they cover.
If a service-specific written agreement expressly conflicts with these general Terms, the service-specific agreement will control with respect to that service.
